Terms of Use
Last updated: 8 November 2026
These terms of use are available in German and English. In case of any discrepancy, the German version prevails.
1. Provider and scope
-
The provider of the mobile game “Toast Commando” (the “game”) is:
Maximilian Schnedhuber
IT Service Schnedhuber
Talstraße 231
72250 Freudenstadt
Germany
Phone: +49 7441 5209002
Email: maximilian@schnedhuber.de(“we”, “us”).
-
These terms apply to the use of the game, including all updates, test versions and content you receive or buy in the game.
-
In addition, the terms of the store you get the game from (Google Play or, if available, the Apple App Store) apply to downloading the game and to purchases. Statutory rights you have as a consumer are not affected by these terms.
2. Conclusion of the contract
-
The contract for using the game is concluded when you install the game and agree to these terms on first start.
-
You can view, save and print these terms at any time at toast-commando.schnedhuber.de/terms. We do not store a separate copy of the contract for you.
-
The contract languages are German and English.
3. Our service
-
The game is free. You can play all of it without buying anything and without watching ad videos.
-
We keep developing the game and provide updates for it. We provide the updates needed to keep the game in conformity with the contract (including security updates) to the extent required by law (§ 327f German Civil Code, BGB).
-
Beyond what is necessary, we may change the game if there is a valid reason, in particular: adapting to new devices, operating systems or store requirements; fixing bugs and security issues; game balance (e.g. difficulty, rewards, prices in Butter); new content; legal requirements. Changes do not cause you any additional costs. We inform you clearly and comprehensibly about the change. If a change impairs your access to purchased content or its usability more than insignificantly, we inform you in good time beforehand; you can then end the affected contract free of charge within 30 days under § 327r BGB.
-
You have no claim that particular free features, game modes or events remain available permanently. Sections 4 to 7 and your statutory rights apply to purchased content.
-
Features that need an internet connection or third-party services (purchases, reward videos, cloud save) are only available as long as these services can be reached.
-
If we stop offering the game or switch off the store features, we will announce this at least 30 days in advance in the game and on toast-commando.schnedhuber.de. Your statutory rights regarding content you have already bought are not affected.
4. In-app purchases
-
You can choose to buy content in the game for real money, for example Butter packs, the Golden Toaster, the Monthly Card, Battle Pass Premium, the No-Video Pass, the Big Butter Barrel and starter deals.
-
Purchases are made exclusively through the store you downloaded the game from (Google Play Billing or, if available, Apple in-app purchase). The store operator handles payment and processing of the purchase under its own terms. We do not receive any payment data.
-
The price is shown to you in your local currency in the game and in the store’s purchase dialog before every purchase. The price in the store’s purchase dialog is decisive. The purchase only takes effect when you expressly confirm it in the store’s purchase dialog.
-
After the purchase, the game credits the content to your game progress. If paid content does not arrive, write to us at maximilian@schnedhuber.de; via “Restore purchases” in the settings you can retrieve one-time purchases (Golden Toaster, No-Video Pass, Battle Pass Premium of the current season) again.
-
No subscriptions: all purchases are single purchases. Nothing renews automatically, and there is nothing to cancel.
-
Time-limited content:
- Monthly Card: you receive Butter immediately and then, for 30 calendar days (the day of purchase counts as day 1), a daily Butter reward that you collect in the game. Days not collected expire. You can buy the Monthly Card again; it does not renew by itself.
- Battle Pass Premium applies to the season in which you buy it.
- Starter deals are only available for a period shown in the game after installation, and each deal only once.
The game shows the duration and scope of every offer before purchase.
5. Right of withdrawal for purchases
-
As a consumer you generally have a statutory right of withdrawal of 14 days for purchases of digital content.
-
For digital content not supplied on a tangible medium, the right of withdrawal expires once performance has begun if, before the purchase, you expressly agreed that performance begins before the end of the withdrawal period, confirmed that you know you thereby lose your right of withdrawal, and received a confirmation of the contract (§ 356(6) no. 2 BGB). For purchases in the game, the content is credited immediately after the purchase; the store obtains the consent and acknowledgement during the purchase process, and the store sends you the purchase confirmation.
-
You request a withdrawal or refund from the store operator you bought from (with Google Play via the order history of your Google account, with Apple via its page for reporting a problem). You can also contact us at any time.
-
If the store refunds a purchase, we may remove the refunded content from your game progress to the extent it is still there.
6. Butter and virtual items
-
“Butter” is the game’s virtual currency. You get it by playing, as a reward or by purchase. With Butter you can unlock virtual items in the game, such as weapons, outfits, pets or game modes.
-
Butter and virtual items are part of the game. You receive a simple, non-transferable right to use them within the game for private purposes.
-
Butter and virtual items have no monetary value. They cannot be exchanged for money or paid out, transferred to others, or traded or exchanged outside the game. Your statutory rights in case of defects or withdrawal (sections 5 and 11) are not affected.
7. Random content
-
With some offers, part of the content is random, for example the type of a weapon you buy with Butter, or the weapon type in a starter deal, in the first Big Butter Barrel or in Battle Pass Premium.
-
The game shows the odds before the purchase. All possible outcomes are equally likely.
-
There are no loot boxes or other gambling mechanics for real money.
8. Optional reward videos
-
For certain benefits (e.g. double money for a while) you can choose to watch an ad video from Google AdMob. There are no forced ads and no banners.
-
You only get the reward if the video was watched to the end. There is no claim that a video is available at all times.
-
With the No-Video Pass you get these benefits without a video.
-
What happens to your data is described in the privacy policy.
9. Age and minors
-
The game is intended for people aged 13 and over.
-
If you are not yet of legal age, you need the consent of your parents or other legal guardians for purchases. The stores offer purchase approval and parental controls for this (e.g. Google Family Link).
10. Your obligations and consequences of manipulation
-
You may only use the game as intended. In particular, the following are not allowed:
- cheats, bots, macros or other programs that automate the game or give you unfair advantages;
- modifying the game progress, the game or its data traffic, for example to create Butter, items or purchases;
- exploiting known bugs instead of reporting them to us;
- circumventing the purchase process or protective measures;
- reverse engineering, decompiling or modifying the game, except where the law expressly allows it (§§ 69d, 69e German Copyright Act, UrhG, remain unaffected).
-
If someone breaches these rules, we may respond appropriately, taking into account the seriousness of the breach and your legitimate interests. In particular, we can remove or reset Butter, items or progress created through manipulation and adjust the cloud save accordingly. In case of serious or repeated breaches we can terminate the contract for good cause. We only take lawfully purchased content from you to the extent it was itself obtained through the manipulation.
11. Statutory rights in case of defects
The statutory rights in case of defects of digital products (§§ 327 et seq. BGB) apply to the game and to purchased content. We do not restrict these rights.
12. Game progress
-
Your game progress is stored on your device. If you uninstall the game, clear the app data or change devices, it is lost unless you use a backup.
-
As a backup, the game offers the cloud save via Google Play Games (or iCloud, if available). Android’s backup to your Google account can also include the game progress.
-
Without a cloud save, only one-time purchases can be retrieved via “Restore purchases” when you change devices (section 4 no. 4), but not used or consumable content such as Butter, and not your game progress.
-
We are only liable for the loss of game progress in accordance with section 13.
13. Liability
-
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (ProdHaftG) and to the extent we have given a guarantee.
-
In case of slight negligence we are only liable if we breach an essential contractual obligation, i.e. an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely. In this case liability is limited to the foreseeable damage typical for the contract.
-
Otherwise our liability for slight negligence is excluded.
-
These rules also apply to our vicarious agents and legal representatives.
14. Rights to the game
All rights to the game, its graphics, texts, sounds and code belong to us or our licensors. You receive a simple, non-transferable right to use the game on your devices for private purposes.
15. Term and termination
-
The contract runs for an indefinite period. You can end it at any time by uninstalling the game.
-
The right of both parties to terminate for good cause remains unaffected.
16. Changes to these terms
-
We may change these terms for the future if laws, case law or store requirements change or if we introduce new features.
-
A new version only applies to you once you have agreed to it in the game. Before that, we show you what changes. If you do not agree, the previous version continues to apply to you.
17. Privacy
Which data the game and the website process is described in the privacy policy.
18. Applicable law and jurisdiction
-
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with your habitual residence in another country, you keep the protection of the mandatory provisions of that country (Art. 6(2) Rome I Regulation).
-
We do not make any agreement on jurisdiction with consumers; the statutory rules apply.
19. Consumer dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
20. Contact
Send questions, problems with purchases or bug reports to maximilian@schnedhuber.de or call +49 7441 5209002.
